GENERAL TERMS OF USE AND PRIVACY POLICY  

 

This website is operated and owned by Jernej Horvat s.p., Vučja Gomila 149, 9208 Fokovci, VAT ID: 77959094. These terms and conditions set out the conditions under which you can use our website and services. By using our website, you confirm that you have read, understand and agree to these terms and conditions.  

 

AVAILABLE INFORMATION  

Jernej Horvat s.p. undertakes to provide the buyer with the following information before the contract or offer binds him: information about the owner (name, registered office and registration number); contact details (email, phone and address); characteristics of the products on offer; availability of the products offered; terms of delivery of products (method, place and date of delivery); the price of the product, which must be clearly stated or include VAT, transport or other costs; payment and delivery options; clarification of the complaint procedure.

 

TERMS OF USE OF THE WEBSITE

You must be at least 18 years old to use our website or receive our services. You may not receive the Site or Services if it is prohibited in your country or under applicable laws or regulations.  

 

COMMERCIAL CONDITIONS  

By purchasing a product, you agree that:   You are responsible for reading the list and information about each product before purchasing. enter into a legally binding contract for the purchase of the product when you commit to purchase it and complete the order and payment process; The prices quoted from your order are valid for this order   The prices we charge for our products are listed on the website and do not include VAT. The price does not include the cost of packing.  

 

PURCHASE PROCESS  

Product selection: Before placing an order, it is necessary to select the desired products on the online store. To do this, click on the "Add to cart" button in the view of each product.   Cart confirmation; After the properly selected products, you move to the cart page. Here you can review your selected products again and change their quantity accordingly, add new products or remove them from your cart. A special discount box called "Enter promo code" is also enabled on this page. You can enter the code in this field, if you have one, and confirm it by clicking on the "Apply" button. By clicking on the "Complete Purchase" button, you are redirected to the last step of the purchase process.   Application: In this step of the purchase, you can log in and submit personal information. The submission of personal data is intended for delivery only and is in accordance with the GDPR. You can make a purchase as a guest (quick purchase, without further data storage) or you can register and make the purchase through the registration process.

Payer's details and delivery to another address: Enter your payer information. If you do not provide another delivery address, we will send the package to the information provided. You can enter the delivery information by ticking the box "Delivery to another address". The delivery address may be different from your personal address – in this case, we will send the selected products to the selected address.   Delivery: Delivery with the GLS delivery service is available. Personal pick-up at the company's location is also possible.   Payment: You choose how you want to pay for your order. Depending on the selected step, you will need to enter certain data (card number, ...). Next, it is necessary to confirm that you have read the general terms and conditions and that you are placing an order with an obligation to pay. By clicking on the "Complete Purchase" button, your order is placed. By prior arrangement, it is also possible to pay in cash upon pick-up.  

 

PURCHASE PROCESS AFTER PLACING AN ORDER  

Order in the queue: After placing the order, the buyer receives a notification by e-mail that the order has been accepted for PROCESSING. In the case of payment by pro forma invoice, the buyer receives a notification with the status HELD and information on how to make the payment. The buyer always has access to information on the status and content of the order on the provider's website.

Order confirmed: The order goes to further processing, when the provider reviews the order, checks the availability of the ordered items. In order to verify the data or ensure the accuracy of the delivery, the provider may call the buyer on his contact phone number, which he added when placing the order. The contract for the purchase of ordered items between the buyer and the provider is irrevocably concluded at this stage.  

Goods shipped: The provider prepares, dispatches the goods within the agreed deadline and informs the buyer about it by e-mail (notification with the status COMPLETED).  

 

ORDERING PRODUCTS  

Before purchasing alcoholic beverages, you confirm that you are of legal age to purchase and consume alcoholic beverages. The buyer is responsible for entering the data he provides when placing the order. The provider is not responsible for delivery errors due to incorrect address or other incorrectly entered information. When placing an order, the buyer declares that he has read, understands and agrees with the general terms of use. The sales contract between Jernej Horvat s.p. and the buyer is concluded in the online store when Jernej Horvat s.p. sends an e-mail about the status of the buyer's order. Subsequent changes to the customer's data after placing an order cannot be changed.  

 

PACKAGING  

Ordered products are usually packed in a cardboard box, with a larger order there can be several packages. We carefully pack each product or set so that it is not damaged during transport.

 

PAYMENT OPTIONS  

Payment by pro forma invoice: When paying by pro forma invoice, you will receive instructions and payment data to our bank account to your e-mail address as soon as possible. After the payment is made, you can send a receipt for the payment. This allows for faster processing of your order. The order will not be dispatched until we receive payment in our bank account. The deadline for payment by pro forma invoice is 3 working days (then the order will be cancelled)  

Credit/Debit Card (VISA, MasterCard, Maestro, American Express, Discover): When paying with credit cards, you will need to enter your card details (card number, expiry date and CVC code) before placing your order. When you click on the Complete Purchase button, the credit card is authorized in real time with immediate verification of data with banks. Of all the payment methods, this is certainly the safest and fastest form and is therefore the most desirable. We use appropriate technological and organizational means to protect the transfer and storage of personal data and payments.

PayPal: Payments via PayPal. To do this, you need a user account on the PayPal page. - Not currently in use ​ Payment on delivery by cash or card by prior arrangement.  

 

PRODUCT DELIVERY:  

We ship our products in the store with the GLS delivery service. We usually ship the order the next day or two after receiving the transfer, but we reserve the right to ship the order within 5 working days in some cases. Delivery within Slovenia usually takes 1-3 working days. Shipping costs are calculated and added to the order before the final confirmation of the purchase. Delivery of an order in Slovenia is 5.0 €, and free delivery is when purchasing products for 60 € or more (applies only to Slovenia). The price for shipping to other EU countries is listed on the page.  

 

REFUND POLICY & WITHDRAWAL FOR WITHDRAWAL  

In the case of distance or off-premises contracts, the consumer has the right to inform the undertaking within 14 days that he is withdrawing from the contract without having to give a reason for his decision. The notice of withdrawal may be exercised by the right to withdraw from the contract in accordance with Articles 134, 135 and 136 of this Act and submitted to the company on the form referred to in the fifth paragraph of Article 138 of the ZVPot-1 or by means of an unambiguous statement from which it is clearly stated that the withdrawal from the contract is being withdrawn. If the consumer has already received the goods and withdraws from the contract, he shall return or hand them over to the company or a person authorized by the company to take over the goods, immediately or no later than 14 days after the notification referred to in Article 134 of this Act, unless the company offers to take over the returned goods itself. The consumer is considered to return the goods in a timely manner if he sends them before the expiry of the 14-day return period. In the event of withdrawal from the contract, the company shall immediately and no later than 14 days after receipt of the notice of withdrawal from the contract return all payments received." If the consumer does not have the right to withdraw from the contract under Article 135 of the ZVPot-1, he is explicitly informed of this.

Please note the following:  

You can return the products in the country where the product was purchased;

the product must be returned to Jernej Horvat s.p., Vučja Gomila 149, 9208 Fokovci, Slovenia;

The product must be intact and sealed with our seal. If you have received a product that is damaged, opened or altered in any other way upon delivery, please reject the goods and contact the delivery service;

Refunds will be returned as soon as possible, but no later than 14 days from the receipt of the notice of withdrawal of the contract.

The company Jernej Horvat s.p. will store the text of the contract and it will be accessible to the consumer (second paragraph 7 of Art.).  

 

COMPLAINTS AND DISPUTES  

Jernej Horvat s.p. acts in accordance with the applicable legislation on customer protection and strives to fulfil its duty to ensure an effective complaints system. In case of problems, the buyer can contact Jernej Horvat s.p. by phone 00386 41 538 079 or by email beyondmuradistillery@gmail.com. The complaint procedure is confidential. The online store will confirm that it has received the complaint within five working days, inform the customer how long it will process it and keep him informed about the progress of the procedure.  

The online marketplace is aware that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to bring a dispute to court. Therefore, the online store does its best to resolve any disputes amicably. In the case of judicial dispute resolution, the court of the consumer's domicile has jurisdiction.  

 

 

OUT-OF-COURT SETTLEMENT OF CONSUMER DISPUTES  

In accordance with legal norms, we do not recognize any provider of out-of-court settlement of consumer disputes as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Resolution of Consumer Disputes Act.

 

COPYRIGHT  

All texts, images, graphics, animations and other documents contained in the website may not be copied, distributed, modified or reproduced in any other way except with the written consent of Beyond Mura distillery.

We undertake not to sell, lend or in any other way to third parties the information you provide through the websites or in any other way. All data will be treated confidentially and will be used only for internal records and for the purpose for which they were provided. Your data will be carefully protected against loss, misuse, unauthorized access, disclosure, alteration or destruction. When you visit the site, some information (IP address, date, time, address of the page you are coming from) is stored on the server. This data is anonymous and is used only for statistical processing. Websites use "cookies". These are small files that are saved to your disk when you visit the site. Cookies can make it easier for you to continue visiting the site. You can use the settings in your browser to decide whether to accept or reject "cookies". If you do not accept "cookies", some websites may not be displayed correctly or you may not be able to access all the information or functionality of the websites.

In the event of referencing or linking these websites to others owned or operated by third parties, Beyond Mura Distillery assumes no responsibility for the content or proper functioning of these websites.

 

FAMILIARIZATION WITH THE LEGAL GUARANTEE FOR THE CONFORMITY OF GOODS/SERVICES/DIGITAL CONTENT (first para. Article 18)

In the event of a lack of conformity of the goods, the consumer who has informed the seller of the lack of conformity of the goods shall, under the conditions and in the order set out in this section, be entitled to:  1. Requires the seller to bring the goods into conformity free of charge; 2. request a reduction in the price in proportion to the lack of conformity or withdraw from the contract of sale and demand reimbursement of the amount paid. The consumer may request the seller to bring the goods into conformity free of charge free of charge without significant inconvenience to the consumer, within a reasonable period of time from the moment of notifying the seller of a lack of conformity not exceeding 30 days, taking into account, in particular, the nature of the goods and the purpose for which the consumer needs the goods. The time limit referred to in the previous paragraph may be extended to the minimum time necessary to complete the repair or replacement, but by a maximum of 15 days. When determining the extended time limit, account shall be taken of the nature and complexity of the goods, the nature and seriousness of the lack of conformity and the effort required to complete the repair or replacement. The seller shall inform the consumer of the number of days for the extension of the deadline and the reasons for its extension before the expiry of the deadline referred to in the previous paragraph. Conformity of goods shall be deemed to be brought into conformity free of charge if the seller also bears the payment of the necessary costs incurred in bringing the goods into conformity, in particular the costs of shipping, transport, labour or material. In order to bring the goods into conformity, the consumer may choose between repairing the goods and replacing them with new defective goods, unless: - it is impossible to satisfy the selected warranty claim, or; - the fulfillment of the selected warranty claim represents a disproportionate cost for the seller compared to another warranty claim, taking into account all the circumstances.
