These terms and conditions specify the conditions under which you can use our website and services. By using our website, you confirm that you have read, understand and agree to the stated terms.

Jernej Horvat s.p. undertakes to provide the buyer with the following information before the contract or offer binds him:

  • information on the owner (name, registered office and registration number);

  • contact details (email, phone and address);

  • product features on offer;

  • availability of offered products;

  • terms of delivery of products (method, place and time of delivery);

  • the price of the product, which must be clearly identified or include VAT, transport or other costs;

  • payment and delivery options;

  • the period within which it is possible to withdraw from the contract and the conditions for withdrawal (description of the right of withdrawal in accordance with Article 43.c ZVPot; in cases where the buyer does not have the right to withdraw in accordance with Article 43.c ZVPot, it is explicit informed);

  • clarification of the appeal procedure

 

 

TERMS AND CONDITIONS FOR USING THE WEBSITE

 

To use our website or receive our services, you must be at least 18 years old. You may not receive the Website or Services if this is prohibited in your country or in accordance with applicable laws or regulations.

 

 

COMMERCIAL CONDITIONS

 

By purchasing the product, you agree that:

 

  • you are responsible for reading the list and information about each product before buying;

  • enter into a legally binding contract to purchase the product when you agree to purchase it and complete the order and payment process;

  • the prices quoted from your order are valid for this order

 

The prices we charge for our products are listed on the website and do not include VAT. The price does not include packaging costs.

 

 

PURCHASE PROCEDURE

 

Product selection:

Before placing an order, it is necessary to select the desired products on the online store. To do this, click on the "Add to cart" button in the view of each product.

 

Basket confirmation;

After the appropriately selected products, move to the cart page. Here you can review your selected products and change the quantity accordingly, add new products or remove them from the cart. A special discount field called "Enter promo code" is also available on this page. You can enter the code in this field, if you have one, and confirm it by clicking on the "Apply" button. By clicking on the "Complete purchase" button, you are redirected to the last step of the purchase process.

 

Login:

You can log in and submit personal information in this purchase step. The submission of personal data is for delivery purposes only and is in accordance with the GDPR. You can make a purchase as a guest (quick purchase, without further storage of data) or you can register and make a purchase through the registration process.

 

Payer's information and delivery to another address:

Enter the payer information. If you do not specify another delivery address, we will send the package to the specified information. You can enter the delivery information by ticking the box "Delivery to another address". The delivery address may be different from your personal address - in this case we will send the selected products to the selected address.

 

Delivery:

Delivery with GLS delivery service is available.Personal collection is also possible at the company's location.

 

Payment:

You choose how you want to pay for your order. Depending on the selected step, you will also need to enter certain data (card number, (). It is then necessary to confirm that you have read the general terms and conditions and that you are placing an order with an obligation to pay. Clicking on the “Complete Purchase” button is  your order placed.By prior arrangement, payment is also possible in cash upon receipt.

 

 

PURCHASE PROCEDURE AFTER PLACING THE ORDER

 

Queue order:

After placing the order, the customer receives a notification by e-mail that the order has been accepted for PROCESSING. In the case of payment by proforma invoice, the buyer receives a notification with the status RETAINED and information on how to make the payment. Information on the status and content of the order is always available to the buyer on the provider's website.

Order confirmed:

The order goes into further processing when the provider reviews the order, checks the availability of the ordered items. The bidder may call the buyer on his contact telephone number, which he added when placing the order, in order to verify the data or ensure the accuracy of the delivery. The contract on the purchase of ordered items between the buyer and the provider is irrevocably concluded at this stage.

 

Goods sent:

The bidder prepares, dispatches the goods within the agreed deadline and notifies the buyer by e-mail (notification with the status CLOSED).

 

 

ORDERING PRODUCTS

 

Before buying alcoholic beverages, you confirm that you are an adult for the purchase and consumption of alcoholic beverages. The customer is responsible for entering the data he provides when placing the order. The provider is not responsible for delivery errors due to incorrect address or other incorrectly entered data. When ordering, the customer declares that he has read, understands and agrees to the general terms of use. The sales contract between Jernej Horvat sp and the customer is concluded in the online store when Jernej Horvat sp sends an electronic message about the status of the customer's order. Subsequent changes to customer data after placing an order cannot be changed.

 

 

PACKING

 

Ordered products are usually packed in a cardboard box, with a larger order there can be several packages. Each product or set is carefully packed so that it is not damaged during transport.

 

 

PAYMENT OPTIONS

 

Cash in Advance:

When paying by proforma invoice, you will receive instructions and data for payment on our bank account to your e-mail address as soon as possible. After payment, you can send proof of payment. This will allow your order to be processed faster. The order will not be shipped until we receive payment into our bank account. The deadline for payment according to the proforma invoice is 3 working days (then the order will be canceled)

 

Credit / debit card (VISA, MasterCard, Maestro, American Express, Discover):

When paying by credit card, you will need to enter your card information (card number, expiration date and CVC code) before placing your order. By clicking on the Complete Purchase button, the credit card is authorized in real time by immediately checking the data with the banks. Of all the payment methods, this is certainly the safest and fastest form and is therefore the most desirable. We use appropriate technological and organizational means to protect the transfer and storage of personal data and payments

Paypal:

Payments via paypal. You need a Paypal user account for this option. - Not currently in use

Payment on delivery in cash or paying card by prior arrangement.

 

 

PRODUCT DELIVERY:

 

We send our products to the store with the GLS delivery service. We usually send the order the next day or two after receiving the transfer, but we reserve the right to send the order within 5 working days in some cases. Delivery within Slovenia usually takes 1-3 working days. Shipping costs are calculated and added to the order before the final confirmation of purchase. Delivery of the order in Slovenia is € 5.0, and free delivery is for the purchase at 60€ or more (applies only for Slovenia). The price for shipping to other EU countries is listed on the page.

 

 

RETURN RULES

 

The buyer has the right to inform the provider via email within 14 days of receiving the product that he withdraws from the contract, without the necessary explanation for his decision. Return the undamaged product with the packaging and the original invoice within 14 days of receiving the product. We will refund your purchase price based on your payment or otherwise. Please note the following:

 

  • you can return the products in the country where the product was purchased;

  • The product must be returned to Jernej Horvat sp, Šentpavel pri Domžalah 25, 1230 Domžale, Slovenia

  • the cost of return is borne by the buyer

  • the product must be undamaged and sealed with our seal. If you receive a product that is damaged, opened or otherwise altered at the time of delivery, reject the goods and contact the delivery service;

  • returns are returned as soon as possible, but no later than within 30 days of receipt of the returned goods.

 

 

COMPLAINTS AND DISPUTES

 

Jernej Horvat s.p. operates in accordance with applicable customer protection legislation and strives to fulfill its duty to ensure an effective grievance system. In case of problems, the customer can contact Jernej Horvat sp by phone 00386 41 538 079 or by email beyondmuradistillery@gmail.com. The appeal procedure is confidential. The online store will confirm within five working days that it has received the complaint, inform the customer how long it will take to process it and keep him informed about the progress of the procedure.

 

The e-commerce is aware that the essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating litigation. Therefore, the online store strives to the best of its ability to resolve any disputes amicably.

In the case of judicial settlement of disputes, the court having jurisdiction over the consumer's domicile has jurisdiction.

 

 

OUT-OF-COURT SETTLEMENT OF CONSUMER DISPUTES

 

In accordance with legal norms, we do not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act. The online store, which as a provider of goods and services enables online shopping in Slovenia, publishes an electronic link to the online consumer dispute resolution platform (SRPS) on its website. The platform is available to consumers at the link HERE. The said regulation derives from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) no. Regulation (EC) No 524/2013 of the European Parliament and of the Council on online settlement of consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22 / EC.
